Welcome to the I-Sense Float Tanks terms and conditions for use. These Terms and Conditions apply to the use of this website at www.isensefloat.com and related services. By accessing the website www.isensefloat.com and/or placing an order, you agree to be bound by these terms and conditions.

Using this website indicates that you accept these terms regardless of whether you choose to register with us or order from us. If you do not accept these terms, do not use this website.

The www.isensefloat.com website is operated by Sunscape Innovations Ltd, a company registered in England and Wales, whose registered office is at Unit 15 Hockliffe Business Park, Watling Street, Hockliffe, LU7 9NB.

1. INTRODUCTION

You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.
We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

2. ORDERING FROM US

You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
Our acceptance of an order takes place when we dispatch the order or send you confirmation by email. When we dispatch the order or send you confirmation by email the purchase contract will be made and you will be charged, unless we have notified you that we do not accept your order, or you have cancelled your order.
We may refuse in our discretion to accept an order:

where we cannot obtain authorisation for your payment;
if there has been a pricing or product description error; or
if you do not meet any eligibility criteria set out in our terms and conditions.
services or information ordered by you are not available;
where goods, services or information ordered by you are not available;
if we do not deliver to your area;
We believe there is a conflict of interest and no legitimate reason for purchase, i.e. not for home or commercial floatation centre use.
Where we do not accept your order but have processed your payment, we will re-credit your account with any amount deducted by us from your debit or credit card as soon as possible, but in any event within 30 days of your order. We will not be obliged to pay any additional amount as compensation for disappointment.

We may cancel an order and refund the deposit for any reason, including but not limited to the reasons above (3.).

3. PRICING & DEPOSITS

All prices exclude VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.

Deposit payments for float tanks are non-refundable. All new float tanks are built to order with components being ordered for the specific float tank build on receipt of deposit.

Invoices for servicing and hardware upgrades are due immediately upon completion of the work. We do not offer any credit terms. Failure to pay outstanding invoices may result in suspension of services, including but not limited to 'Cloud Control' and any future software updates.

4. INSTALLATIONS & DELIVERY

We will deliver goods ordered by you as soon as possible to the address you give us for delivery, but in any event within 120 days of your order. (Excluding products made to order.)
If the goods we deliver are not what you ordered or are damaged or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing, at our contact address, of the problem within 10 working days of the delivery of the goods in question
If you do not receive goods ordered by you within 120 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 days of our maximum delivery period of 120 from the date on which you ordered the goods.
A float tank order is not confirmed until deposit payment is made.
Balance payments must be received atleast 48 hours before the scheduled delivery/installation.

5. PRODUCT LIABILITY & WARRANTY

All orders operate under business-to-business terms and are exempt from the Consumer Rights Act 2015, unless a specific agreement is reached to make a transaction between the seller and an end consumer.

In the event that you report an issue to us under this provision, our sole obligation will be to provide one of the following options, as per your preference:

to make good any shortage or non-delivery
to replace or repair any goods that are damaged or defective; or
to refund to you the amount paid by you for the goods in question in whatever way we choose.

Except where prohibited by law, we shall not be held liable for any indirect or consequential losses, damages, or expenses (including but not limited to loss of profits, business, or goodwill) arising from any issues reported under this provision. We shall not be obligated to provide compensation in any form.

You are required to adhere to all relevant regulations and laws, including obtaining any necessary customs, import, or other permits required for the purchase of goods from our platform. Certain national laws might prohibit the import or export of some goods to you. We are not responsible for consequential losses if you fail to minimise such costs. Prior consultation with us is advisable before incurring such expenses.

I-Sense Float Tanks disclaims all liability for any loss or damage to personal property resulting from the use of our float tanks. This disclaimer includes a variety of potential scenarios, including but not limited to water spillage, overfilling, leaks originating from filters, pipes, and jets, as well as potential damage to flooring and carpets. By proceeding with the use of our products, you acknowledge and agree that the installation area of the floatation tank will have sufficient protection and drainage measures against water leaks and spillage. Furthermore, you understand and accept that the manufacturer cannot be held accountable for any damage arising from user error or product malfunction.

Products manufactured by I-Sense Float Tanks are covered by warranty. 2 years on heater, pump and UV, 2 years on the tank structure and surface. 1 year on other components. Warranty for customers within the United Kingdom include labour in the event that the fault requires attendance of an engineer. Orders from outside of the UK are subject to a parts-only warranty. Replacement parts will be shipped directly and instructions provided for installation.

All warranties apply to the original purchaser only, at the original address that the float tank was delivered to, and is non-transferable. I-Sense Float Tanks reserves the right to charge a fee for support on products out of warrant and/or not owned by the original purchase.

Used or refurbished products are not covered by any warranty unless explicitly stated on the listing page.
Please be aware that used or refurbished products are not in brand-new condition; they may exhibit imperfections and show signs of wear and tear.

6. CANCELLATION OF CONTRACTS FOR GOODS AND RETURNS POLICY – FOR ACCESSORIES ONLY

This section applies to consumers only (and not to businesses or other organisations) who order goods
If you wish to cancel your order:

you can notify us by email to sales@isensefloat.com before we have dispatched the goods to you; Please be advised that cancellation will result in loss of deposit.

You can return goods (excluding float tanks and made to order items) you have ordered from us for any reason at any time within 14 days of receipt for a full refund or exchange.
Upon receipt of the goods we will give you a full refund of the amount paid, or an exchange credit as required, less (if for any reason these costs have not been paid by you) the costs of delivery to us.
The rights to return the goods to us as referred to in clause 6.3 will not apply in the following circumstances: –

*in the event that the product has been used
*to any products that we have made or customised specifically for you
The provisions of this clause do not affect your statutory rights.

7. LICENCE

You are permitted to print and download extracts from this Website for your own private use on the following basis:

no documents or related graphics on this Website are modified in any way;
no graphics on this Website are used separately from accompanying text; and
any of our copyright and trade mark notices and this permission notice appear in all copies.

Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of such material other than in accordance with this clause for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use such material automatically terminates and you must immediately destroy any such material
Subject to this clause, no part of such materials may be reproduced, displayed, modified, sold or stored without our prior written permission.
Any rights not expressly granted in these terms are reserved.

8. SERVICE ACCESS & CLOUD CONTROL

While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.
Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
I-Sense Cloud is a paid subscription provided for clients to enable them to access and control their float tank dashboard from anywhere with an internet connection. An active Cloud subscription is required for software updates. Access to this service may be restricted if the client is in debt of any unpaid invoices for more than 14 days. Refer to Section 3 for details of invoice conditions.

9. VISITOR MATERIAL AND CONDUCT

Other than personally identifiable information, which is covered under the Privacy Policy, any material you transmit or post to this Website will be considered non-confidential and non-proprietary. We will have no obligations with respect to such material. We and our nominees will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for all commercial or noncommercial purposes.
You are prohibited from posting or transmitting to or from this Website any material:

that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; (b) for which you have not obtained all necessary licences and/or
